In a recent open letter to the ISO FreeCode CEO Geir Isene calls for standardization in the processes used by the ISO to help prevent future OOXML blunders. "It seems ISO is not prepared for a politicized process where a big and influential commercial enterprise will use any means possible to push its own standard through to certification. Committees are flooded by the vendor in support of the standard. Votes are bought and results are hijacked. Several national bodies have flawed and skewed procedures open for corruption."

The Escapist is reporting that the Entertainment Software Association (ESA), frustrated with the costs incurred from their successful battle to overturn the state's violent videogame law, is now going after California for legal fees. "The ESA is claiming the legal battle, which led to the overturning of the "fundamentally flawed" law, cost a total of $324,840. If granted, it will bring the costs awarded to the industry in First Amendment defenses to nearly $1.9 million, spread across eight other jurisdictions that had attempted to pass similar laws." The site also reports that California Governor Schwarzenegger has followed through on his promise to appeal that overturn, seeking to restore the legislation championed by Leland Yee.

They had already cleared at least two police checkpoints, according to CNN, disguised as a Canadian motorcade. 'No particular reason we chose Canada,' said Taylor. 'We just thought they'd be a country who the cops wouldn't scrutinize too closely, and who feasibly would only have three cars in their motorcade — as opposed to the 20 or so gas guzzlers that Bush has brought with him.'" CNN has a photo of Licciardello, dressed as Osama bin Laden, being arrested.

From the FEC statement: 'While the complaint asserts that DailyKos advocates for the election of Democrats for federal office, the commission has repeatedly stated that an entity that would otherwise qualify for the media exemption does not lose its eligibility because it features news or commentary lacking objectivity or expressly advocates in its editorial the election or defeat of a federal candidate.'"

Countries with a lower score (more corruption) on the 2006 CPI were more likely to vote in favor of OOXML, and those with a higher score were less likely. According to the analysis, 'This statistics supports with a P value of 0.07328 the hypothesis that the corrupted countries were more likely to vote for approval (one-tailed Fisher's Exact test). In other words, simplified a bit: the likelihood that there was no positive correlation between the corruption level and probability of an approval vote, that is, this is just a random effect, is about 7%.' Of course, correlation doesn't prove causality."

Roughly 100 veterans of the Iraq war marched near an elaborate demonstration of the military-funded game, outside of an expo center in Missouri. Their shouts of 'war is not a game' must have contrasted sharply with the elaborate simulator the Army had set up to publicize their (already very popular) FPS title.

The church is accused of being a criminal organization involved in extortion, fraud, unfair trading, violation of privacy laws, and unlawfully practicing medicine. Both the Belgian and the European branches of the church should be brought to court, according to the authorities. The investigation was started in 1997 after former Scientologists complained about intimidation and extortion by the church. Other European countries such as Germany have problems with Scientology, but in the US it is officially recognized as a religion. Scientology has 10 million members including high-profile followers such as Tom Cruise and John Travolta." Scientology has long used heavy-handed legal and other tactics to suppress opposition on the Net.

iFrated informs us of a successful penetration of US Defense Department computers by the Chinese military last June. From the article: "The Pentagon acknowledged shutting down part of a computer system serving the office of Robert Gates, defense secretary, but declined to say who it believed was behind the attack. Current and former officials have told the Financial Times an internal investigation has revealed that the incursion came from the [Chinese] People's Liberation Army. One senior US official said the Pentagon had pinpointed the exact origins of the attack. Another person familiar with the event said there was a 'very high level of confidence... trending towards total certainty' that the PLA was responsible." The PLA is also accused of breaking into German government computers, including a network in the office of the Chancellor.

An anonymous reader sends us to the International Herald Tribune for news that the Bush administration is signaling that it plans to turn once again to a favorite legal tool, the 'state secrets' privilege. The administration wants to shut down a lawsuit brought against Swift, a huge Belgium banking cooperative that that the article calls the "nerve center of the global banking industry," after it was revealed that Swift secretly let the CIA comb through millions of private financial records. Quoting: "Two US banking customers sued Swift on invasion-of-privacy grounds. Many legal and financial analysts expected that the lawsuit would be thrown out because US banking privacy laws are considered much more lax than those in much of Europe. But to the surprise of many, a judge refused to throw out the lawsuit in a ruling in June."

The action comes in response to a court denying prosecutors' requests to break into suspects' computers over the Internet. The German chancellor supports the measure despite considerable outcry from political opponents and rights groups.

These specific investigations centered around Vista's compliance with Google's concerns surrounding search tools for the desktop. From the article: 'Preliminary testing shows the new version, which will let Vista users set a competing search program as their default and see it in the Windows Start menu, works as expected. The changes will be available in Service Pack 1, a package of upgrades and fixes expected in the first quarter of 2008, the department said. The department also said in its report that it is looking into differences between original technical documentation and rewritten versions from Microsoft, and that it is testing fixes Microsoft made to some software.'"

The nation now plans to send a manned mission to the moon by 2025 and establish a permanent base shortly thereafter. 'According to our estimates, we will be ready for a manned flight to the moon in 2025,' Roskosmos chief Anatoly Perminov told state news agency RIA Novosti. A station that could be inhabited could be built there between 2027 and 2032, he said. While Russia will be refurbishing existing spacecraft, the U.S. is taking a different approach after the space station is finished and plans to scrap the space shuttle program in favour of a new kind of spaceship to be called Orion."

He quotes ALLIED TUBE & CONDUIT CORP. v. INDIAN HEAD, INC., 486 U.S. 492 (1988), which says 'What petitioner may not do (without exposing itself to possible antitrust liability for direct injuries) is bias the process by, as in this case, stacking the private standard-setting body with decision makers sharing their economic interest in restraining competition.'"

The states want oversight extended at least through early next year. 'The justice department said in its report that while Microsoft's operating system market share hasn't dropped because of the consent decree, "it would misapprehend the purpose of the Final Judgments to rely on these facts to argue that the Final Judgments have been ineffective. Microsoft was never found to have acquired or increased its monopoly market share unlawfully." In its report, Microsoft directly countered California's claims and said, the "Final Judgments were never designed to reduce Microsoft's share in any putative market."'"

GamePolitics is serving up email transcripts that show increasing tension between Jack Thompson and 2K Games. The two parties have been acting at least vaguely civilly towards each other since an April settlement. A taunting, factually incorrect email from Jack to 2K (and other parties) has set things off again. 2K's response is to-the-point: "We demand that you cease making these false statements about our online sales practices. Your dissemination of knowingly false statements for the purpose of adversely affecting Take-Two's business is actionable and we reserve all of our rights under the settlement agreement and state and federal law. Not only are your statements clearly false, but they were made in an email publicly disseminated to both the FTC and the press.
